Pepsi Max: Terms & Conditions

Please read the full terms and conditions before entering the competition


This competition is promoted and operated by The Deltic Group Limited (Company No: 07870512) whose registered office is Aurora House, Deltic Avenue, Rooksley, Milton Keynes, MK13 8LW (“us”, “we” or “our”).

Details of how to enter form part of these terms and conditions (“Terms”). It is a condition of entry that all rules are accepted as final and that the participant (“you” or “your”) agrees to abide by these rules.


  1. Participation is available to UK residents who are of 18 years of age and older.


  2. Participation is non-transferable and you shall only be entitled to take part once every 24 hours.


    How to enter

  3. Customers will receive a Hot X Rum Scratch Card (“Scratch Card”) with every purchase that includes Captain Morgan. For the avoidance of doubt, only one Scratch Card shall be issued per purchase irrespective of how many Captain Morgan drinks are ordered within each purchase.

  5. Each Scratch Card gives you the opportunity to win various prizes. Details of the current prizes can be found at:


  6. The competition closes at 4am on 04/05/2019. Any customer that purchases a Captain Morgan and Pepsi Max at a participating venue after this date and time shall not receive a Scratch Card and shall not be able to take part in the competition.


    The Prizes

  7. An ‘Instant Win’ means you may claim a free Captain Morgan and Pepsi Max.


  8. A ‘Win’ means you will receive a £100 Live Nation voucher to be spent on festival/gig tickets of your choice (“Voucher”). For the avoidance of doubt, a ‘Win’ only entitles you to one Voucher. Full details of the festival/gig tickets available for purchase can be found at:


  9. Winners of a Voucher must make their own personal arrangements to the festival or gig including, but not limited to, travel, subsistence and accommodation. Such personal arrangements are made at the winner’s own risk and cost.


  10. If you are not fortunate enough to win, you shall not be entitled to any prize and we shall have no liability to you in this regard.


  11. Prizes are non-transferable, non-exchangeable and no cash alternative is offered.


  12. Prizes are subject to availability at participating venues and are subject to change without notice to you throughout the lifetime of the competition.


  13. Prizes may not be transferred or sold. Any Voucher(s) sold may become voidable.


    Claiming the prize

  14. If you ‘Instant Win’ you should claim your prize from the same bar that gave you the Scratch Card.


  15. If you ‘Win’ you must contact a member of the venue’s management team and provide:


    1. the winning Scratch Card;
    2. your full name;
    3. your email address; and
    4. your telephone number.


  16. If we are unable to contact a winner, or the winner is unable to accept the prize within 7 days of notification, we reserve the right to award the prize to an alternative winner and shall not be liable to the original winner in this regard.



  17. Any information and data provided or collected in accordance with the competition will be dealt with in accordance with the provisions of the EU General Data Protection Regulation (2016/679) (“GDPR”).

  19. Personal data supplied during the course of the competition will be passed on to a third-party supplier for fulfilment/delivery/arrangement of the prize.


    Changes to these Terms

  20. We reserve the right to change or amend these Terms.


  21. If you do not accept the notified changes you will not be permitted to enter the competition. If you have already entered the competition, we reserve the right to withdraw your entry and shall not be liable in this regard.



  22. We reserve the right, at our sole discretion, to refuse participation in the competition.


  23. We reserve the right to refuse to award a prize to anyone in breach of these Terms.


  24. Licensing laws in the jurisdiction in which the prize is taken will apply.


  25. The winner may be required to participate in publicity which may include the publication of names and photographs in any media.


  26. Events may occur that render the awarding of the prize impossible due to reasons beyond our control. Accordingly, we may, at our sole discretion, vary or amend the competition and you agree that no liability shall attach to us as a result thereof. We reserve the right to cease the competition, withdraw or substitute any prize at any time prior to redemption of the prize.


  27. We shall under no circumstances whatsoever be liable to you whether in contract, tort (including negligence), breach of statutory duty or otherwise for any loss (including indirect and consequential losses), damage, personal injury or death arising out of, under or in connection with the competition or these Terms.


  28. Insofar as is permitted by law, we, our agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up any prize except where it is caused by our own negligence. Statutory rights would not be affected.


  29. Our decision in all matters is final and binding. No correspondence will be entered into.


  30. Our admissions policy applies: the winner and all guests in their party must be over the age of 18 or, if higher, the age specified within the premises licence for the relevant venue. We reserve the right to refuse entry.


  31. We may at any time assign, transfer, subcontract or deal in any other manner with all or any of our rights or obligations.


  32. These Terms constitute the entire agreement between us and you.


  33. If any part of these Terms is or become invalid, illegal or unenforceable, they shall be deemed modified to the minimum extent necessary to make them valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Such deletion or part deletion shall not affect the validity and enforceability of these Terms.


  34. These Terms are governed by the law of England and Wales and you submit to the exclusive jurisdiction of the courts of England and Wales.
